POS with First Data...anyone interested in class action suit? I now owe over $10,000 on a POS (piece of ***) and the lease reads that they can go into my personal accounts,go into my store at any time, there is no canceling this.
My attorney said it's a good class action suit..anyone want to do this? Never even received a copy of the lease. The saleswoman misrepresented herself.
I feel like I've been robbed.Located in Pgh.The only way to give this POS back is to pay them!This is so wrong! We need to do something about this.

This is the same situation we are in still have 14 months left on a contract for a credit card terminal that is 300 per month and our contract for our processing is up in one month. Why would I have the equipment longer then I'm processing.
They will not let us cancel without buying out the rest of the contract.
We will be out 15,000 dollars in the 4 years for a piece of equipment we can buy brand new for 350.00. We feel as though we were very mislead.
April 2013 we opened a bank account with Bank of America for our new small clothing retail business. After talking to banks in house merchant services for our Point of Sale POS system we were all set to go and should have everything shipped to us within 48 hours for our store opening May 10th.
After leaving the bank branch I received a phone call from another BOA merchant services sale person offering me a better deal than what the bank offered me on my credit card transactions etc. First RED FLAG bank competing with self! Upon several emails back and forth trying to get me to take the better deal from this sales person we did. She was pressing and time was critical to receive for opening.
She sent it all via email and at the time all I could see is on my phone screen (very small) and I told her this but she was pushy to get it electronically initialed to begin the order. I scanned the 75 pages as careful as I could looking for to be stuck in a lease which I told bank and her earlier I did not want to be binned to a contract because we did not know how the business would go in the area we were opening it. Trial and error so to speak. Once I saw in agreement that it was a 48 month contract I emailed her back and said I see that this is in here and I do not want this.
She emailed me back and I quote her exact email "I will waive the $500 early termination fee and you can cancel at any time" I was like ok sounds great. Received equipment later than she promised also did not know that we would have to train over the phone for 2hours and had to also schedule that 4 days after we opened. She promised gift cards which we got but had salt and pepper shakers on them.. We are a clothing store remember!
Also was promised a bar code printer to print labels to put on our clothes also another mess. Called her and it was through another company and they also wanted us to sign a contract. NO I said or I will return all equipment and we will go elsewhere. She promised we would get it and we did but late.
On Oct 15 2013 we closed our doors. Called to return equipment and First Data said I could but had to pay $8,000.00 because we were under contract. OR I could pay $4000 return equipment but still would go against my credit. I called the sales lady several times but like before she never would answer because she was all about email.
I emailed her and told her what First Data said and she said yes that I was and when she said I wasnโt bonded to a contract she was meaning with Bank of America merchant services. Wow what snakes they all are. But thank God I had this email to show my lawyers.
Yes I have hired lawyers and things is going slow and First Data still sends bills almost every 3 days and calls every day even though I have told them that Iโm going to fight them due to me being bonded to a contract under false pretense. I will be willing to help anyone fight this company and try warn others before these snake companies keep sticking it to small businesses.
Yes, a Class Action lawsuit needs to be filed. I am also a victim of their ridiculous overcharges, lies, and run arounds!!!

We had a similar issue with mis-representation and deceptive practices by this company.

EXACTLY!!! This product was horribly misrepresented by Wells Fargo and even though my corporation is closed as of May 2012, they insist I personally owe them until 2015.
I NEVER agreed to this, didn't know another company was even indebting me to a lease I had no idea of....
HELP!!! I absolutely would be happy to join a class action suit.

I am a new customer with Collective POS and therefore First Data and Merchant Services. Have never had such a poor experience in my life!
The sales rep completely misrepresented the services, the contract contradicts itself (I signed a paper contract that refers to an online contract which contradicts the contract I signed) and I can't get any answers!
Stay away from any of these 3 companies!
How do I find information on the class action?
I would like to state that my experience with First Data was worse than just bad. I had to pay enormous fees and charges that I could not even make any profit.
I tried to close my account but they ignored my request. I am not sure how can they get away with what they do to their customers.
I am a law student in Michigan trying to help my dad in Colorado who has had the same luck with this company! Did anyone get any information from their attorney?

We too were scammed by a guy named Timothy Boyd who used to work for Century Payments in Frisco, TX. He photoshopped our signatures and completely made up a fake contract with First Data Global Leasing.
Our attorneys office has been searching for him to serve him the court papers and found out he's now the President of Silverstone Payments.
Of course they denied that he still works there but we're asking the court for a hearing so we can get a judgement and be done with this bs! The hearing is set for June 2013 so let me know if you'd like more info.

this company is the worst ever, can't believe they're still in business with their business practices. we really should get together and put their sorry behinds in front of the world so that their practices are exposed.
